Drive An Limited provides access to certain driving licence information through the Driver and Vehicle Licensing Agency (“DVLA”) Access to Driver Data (“ADD”) service.
The following terms apply whenever you use this functionality within the Drive An platform.
1. Purpose of the ADD Service
The ADD Service enables Drive An to obtain driving licence information from DVLA for legitimate driver licensing, eligibility, compliance, safeguarding and road-safety purposes.
Information obtained through ADD may include your:
- driving licence status and entitlement;
- licence categories;
- endorsements and penalty points;
- offence or endorsement codes;
- disqualifications and restrictions; and
- other driving licence information returned by DVLA.
The underlying driving licence information is provided by DVLA. Drive An does not create or alter your DVLA driving record.
2. Data Protection Declaration
Before an ADD enquiry is made, you will be required to complete the appropriate Data Protection Declaration.
By completing the declaration, you confirm that the information you provide is accurate and acknowledge that Drive An may make DVLA enquiries for the purpose explained to you.
A declaration does not permit Drive An to access or use your DVLA information for unrelated purposes.
Under DVLA ADD requirements, a declaration is valid for no more than three years from the date of signature, or until you cease driving in connection with the relevant purpose or relationship, whichever occurs first.
Drive An may require you to complete a new declaration where your existing declaration expires or where otherwise required by DVLA.
3. Permitted Use
Drive An will only make an ADD enquiry where there is a legitimate and permitted reason to do so.
This may include:
- confirming that you hold a valid driving licence;
- checking your driving entitlement;
- checking endorsements, penalty points or disqualifications;
- assessing driver eligibility;
- supporting taxi and private hire licensing requirements;
- monitoring continuing driver compliance; and
- supporting legitimate safeguarding and road-safety requirements.
DVLA information obtained through ADD will not be used for unrelated marketing, advertising or general intelligence gathering.
DVLA's ADD guidance specifically requires the information to be used for the original reason for which it was requested.
4. Your Responsibilities
You must provide complete and accurate information when using the ADD Service.
You must not:
- provide another person's driving licence details;
- impersonate another driver;
- provide false or misleading information;
- falsify or alter a Data Protection Declaration;
- attempt to access another person's DVLA information; or
- attempt to interfere with or misuse the ADD Service.
Drive An may suspend access where fraud, misuse or unauthorised activity is suspected.
5. ADD Results
ADD results are based on information supplied by DVLA at the time an enquiry is made.
Drive An cannot guarantee that information held by DVLA is complete, error-free or continuously available.
If you believe information contained within your DVLA driving record is incorrect, you may need to contact DVLA to have the underlying record investigated or corrected.
6. Where a Record Cannot Be Returned Electronically
Not all DVLA driving records can be returned electronically through ADD.
Where DVLA returns a 404 response, Drive An may be required to follow DVLA's manual enquiry procedure, including submission of the appropriate Data Protection Declaration to DVLA.
A message such as “No data found” does not necessarily mean that no DVLA record exists or that the driver has no endorsements, penalty points or other relevant information.
The current DVLA ADD guidance says that a 404 record is progressed through its manual enquiry process.
7. Access to ADD Information
Access to live DVLA ADD information within Drive An is restricted to authorised personnel and controlled systems.
At present, Drive An does not make ADD information available to operators or other third-party customers through the Drive An: Manage platform.
If this changes in the future, any sharing or access will be introduced only where the necessary contractual, data-protection and DVLA requirements have been satisfied.
8. Security
Drive An applies technical and organisational measures designed to protect DVLA information against unauthorised access, disclosure, alteration, loss or misuse.
These include controlled access, individual user accounts, multi-factor authentication, access logging and other appropriate security controls.
9. Retention
Drive An retains ADD records only for as long as necessary for the permitted purpose and to meet applicable legal, contractual and audit requirements.
Data Protection Declarations supporting ADD enquiries are retained in accordance with DVLA requirements.
DVLA's current guidance requires supporting declarations to be retained for two years from the date of the relevant ADD enquiry and to remain readily recoverable for inspection.
10. Service Availability
The ADD Service relies on DVLA and other technical services outside Drive An's direct control.
The service may therefore occasionally be unavailable because of maintenance, DVLA outages, technical failures, security incidents or other circumstances beyond our reasonable control.
Drive An may also temporarily restrict or suspend ADD functionality where necessary to protect information or comply with legal, contractual or DVLA requirements.
11. Data Protection
Personal information processed through the ADD Service is handled in accordance with applicable UK data-protection legislation and the Drive An Privacy Policy.
Our Privacy Policy explains in more detail:
- what personal information we collect;
- why we process it;
- our lawful basis for processing;
- how information is protected and retained;
- who information may be disclosed to; and
- your data-protection rights.
12. Changes to the ADD Service
Drive An may amend the ADD Service or these terms where necessary to reflect changes to DVLA requirements, legislation, security requirements or the way the service operates.
Where a material change affects how your personal information is processed, appropriate updated information will be provided.
